Wills

We have a Wills writing department, which professionally drafts wills to a very high standard. Many thousands of pounds can be saved if a Will is drafted properly. It is very important to note that if you do not have a Will then The Rules of Intestacy will come into effect. This means a person's estate may be distributed in a way, which does not comply with your wishes. See below for what happens under The Rules of Intestacy.

Married People

Where there are Children
If your estate if valued below £125,000, the surviving husband/wife will inherit everything. Should your estate be worth more than £125,000 and you have children then the surviving husband/wife receives the first £125,000 plus personal chattels and a life interest in half of what's left. A life interest simply refers to income only from half of the property that is left. Whatever is left will be divided equally between the children when they reach 18 or if they marry before then. Once the surviving spouse dies, the children will receive the rest of the estate.

Where there are no Children
A surviving husband/wife receives the first £200,000 plus personal chattels and half of what is left of the estate. The rest will be divided between surviving parents or else they go to brothers and sisters or nephews and nieces if siblings are deceased.

Unmarried People

Where there are Children
Your estate will be divided equally between your children. If they have already died then it will be divided equally amongst your grandchildren if they survive you.
Where there are no Children
If your parents are still alive your estate will be divided equally between them. However, if they have died then your estate is divided equally between your brothers and sisters or nephews and nieces if your siblings are deceased. If you do not have siblings or nieces and nephews but your grandparents are still alive, your estate is shared equally between them. If you have no grandparents but do have aunts, uncles and cousins, they will inherit your estate. Finally, the Crown will take your estate if you have no family.
